NOTICE OF SUSPENSION Case Nos. 91-65-GA; 91-86-FA Benjamin Dajos, P12448, Coldwater, Michigan, by the Attorney Discipline Board affirming a hearing panel order of suspension.

1) Suspension - 125 days; 2) Effective August 7, 1991. Respondent failed to answer the formal complaint, but appeared at the hearing held in Battle Creek on June 6, 1991. Respondent's default was entered and the panel found that misconduct as to Counts I and II Formal Complaint 91-65-GA was established by the default. Count III of Formal Complaint 91-65-GA and Formal Complaint 91-86-FA were dismissed without prejudice.

Respondent was retained concerning a collection matter, but failed to respond to four letters and two telephone calls from his client over a period of six months; and, failed to answer the request for investigation.

Respondent's conduct was found to be in violation of MCR 9.104 (1-4); MCR 9.103(C); MCR 9.113(B) (2); and the Michigan Rules of Professional Conduct, I.I(c); 1.2(a); 1.3; 1.4(a); 8.1(b); 8.4(a,c).

Respondent filed a petition for review seeking a decrease in the discipline imposed. The Attorney Discipline Board affirmed the hearing panel order of suspension in an order dated March 13, 1992. Costs were assessed in the amount of $276.24.
