NOTICE OF SUSPENSION ADB 149-89 Sandra S. Schultz, P30269, Ironwood, Michigan and Mesa, Arizona, by the Attorney Discipline Board increasing a hearing panel order of reprimand.

1) Suspension - thirty (30) days; 2) Effective September 14, 1991. The hearing panel found that misconduct was established by a preponderance of the evidence. Respondent was retained to further the prosecution of a civil action which had already been filed, but failed to take any action on her client's behalf for a period of eighteen months and failed to timely answer the request for investigation. Respondent's conduct was found to be in violation of MCR 9.104(1,4,7); MCR 9.113(B)(2); and Canons 1 and 6 of the Code of Professional Responsibility, DR 1-102(1,6); DR 6-101(A)(3). The panel imposed a reprimand.

The grievance administrator filed a petition for review seeking an increase in the discipline imposed. In an order issued August 23, 1991, the Attorney Discipline Board increased discipline to a 30-day suspension. Respondent filed a motion for reconsideration and stay of discipline, which was denied by the Board in an order dated September 24, 1991. Costs were assessed in the amount of $955.08.
