1) Revocation; 2) Effective August 23, 1991. The respondent admitted the allegations of the formal complaint, except for the allegation contained in Count V(d)(ii). That count was dismissed by stipulation of the parties.
Respondent, as personal representative of an estate, misappropriated $25,000.00 from the estate, made false statements in accounts filed with the probate court regarding the balance of the bank account and the sums disbursed to himself, failed to promptly administer and account for estate assets, and failed to respond to the inquiries of an estate heir and her attorney.
In a separate matter, respondent was retained to file a divorce action, but failed to prosecute the divorce.
Respondent's conduct was found to be in violation of MCR 9.104 (1-4); Canons 1, 6, 7 and 9 of the Code of Professional Responsibility, DR 1-102(A)(1,3-6); DR 9-102(A); DR 9-102(B)(4); and the Michigan Rules of Professional Conduct, 1.1(c); 1.3; 1.4; 1.15; 8.4(a-c). Costs were assessed in the amount of $244.40.
