1) Reprimand; 2) Effective August 3, 1991. The hearing panel found that misconduct as to Count II(E)(iii) of the formal complaint was established by a preponderance of the evidence. Count I and the balance of Count II were dismissed. Respondent was retained in connection with probate proceedings, but failed to take prompt action to close the estate. Respondent's conduct was found to be in violation of MCR 9.104(1-4); Canons 1, 6 and 7 of the Code of Professional Responsibility, DR 1-101(A) (1,5,6); DR 6-101(A)(3); DR 7-101(A)(1-3); and the Michigan Rules of Professional Conduct, 1.1(c); 1.3; 8.4(a,c). Costs were assessed in the amount of $772.71.
