NOTICE OF REPRIMAND (By Consent)

Case No. 91-99-GA Thomas R. Walcott, P28659, Hazel Park, Michigan, by Attorney Discipline Board Tri-County Hearing Panel #57.

1) Reprimand; 2) Effective October 15, 1991. The respondent and the grievance administrator filed a stipulation for consent order of discipline pursuant to MCR 9.115 (F)(5) which was approved by the hearing panel and the Attorney Grievance Commission. Respondent admitted the allegations contained in count two of the formal complaint. Count one was dismissed by stipulation. Respondent was retained to file suit against the seller and manufacturer of defective bricks purchased by his client to reface his home. For approximately three years, respondent repeatedly implied, through oral representation, that an action had been filed on the client's behalf and that the parties were awaiting a hearing date. Those representations were false and were known by respondent to have been false at the time they were made. Respondent's conduct is found to be in violation of MCR 9.104(1-4); Canon 1 of the Code of Professional Responsibility, DR 1-102(A) (1,4-6); and the Michigan Rules of Professional Conduct, 1.4(a); 8.4(a-c). Costs were assessed in the amount of $60.25.
