NOTICE OF SUSPENSION (By Consent)

Case Nos. 91-46-GA; 91-68-FA Rock W. Lindsay, P39230, Pittsburgh, Pennsylvania, by Attorney Discipline Board Tri-County Hearing Panel #9.

1) Suspension - 150 days; 2) Effective October 26, 1991. The respondent and the grievance administrator filed a stipulation for consent order of discipline which was approved by the hearing panel and the Attorney Grievance Commission. Respondent pleaded nolo contendere to the allegations contained in counts I, II, III and V of formal complaint 91-46-GA, and formal complaint 91-68-FA in its entirety.

Respondent was retained to defend a breach of contract action, but failed to file an answer; failed to respond to plaintiff's motion for entry of default judgment or to file any pleadings requesting that the default be set aside; and failed to respond to his client's inquiries.

Respondent was retained by the same client to defend a separate breach of contract action, but failed to file an answer; failed to appear for a pretrial; failed to file a response to plaintiff's motion for entry of default judgment or to file any pleadings requesting that the default be set aside; and failed to respond to his client's inquiries.

Respondent was appointed to represent a defendant in a criminal appeal, but failed to timely file an appellate brief; failed to appropriately respond to a no progress warning; and failed to comply with an order of the court.

Respondent was retained to represent a defendant in a criminal case, but failed to appear for trial and without notice to his client, respondent abandoned his representation of him and moved out of state.

Respondent's conduct was found to be in violation of MCR 9.104 (1-4,7) and the Michigan Rules of Professional Conduct, 1.1(c); 1.2(a); 1.3; 1.4(a); 8.4(a,c). Costs were assessed in the amount of $70.45.
