1) Revocation; 2) Effective July 25, 1991. Respondent failed to answer the formal complaints, but appeared at the hearing held in Detroit on May 20, 1991. Respondent's defaults were entered and the panel determined that the defaults established the allegations of the formal complaints.
Respondent was automatically suspended for nonpayment of disciplinary costs in a prior matter (ADB 151-88) effective October 15, 1988. Respondent failed to cease and desist from the practice of law, holding himself out as an attorney and appearing as an attorney in court while suspended; filed a false affidavit of compliance with the Michigan Supreme Court; made false statements in pleadings filed with the Attorney Discipline Board; made false statements under oath when subpoenaed by the Attorney Grievance Commission; and presented a check drawn on a closed account to a court for filing fees.
Respondent's conduct was found to be in violation of MCR 9.104 (1-5,9); MCR 9.123(A); MCL 600-916, MSA 27A.916; and the Michigan Rules of Professional Conduct, 3.3(a)(1); 5.5(a); 8.1(a); 8.4(a-c). Costs were assessed in the amount of $410.58.
