NOTICE OF SUSPENSION Case No. 91-90-GA Ethan Vinson, P26608, Detroit, Michigan, by Attorney Discipline Board Tri-County Hearing Panel #26, reducing the panel's order of revocation.

1) Suspension - 18 months; 2) Effective October 5, 1991. Respondent failed to answer the formal complaint and failed to appear at the hearing held in Detroit on July 3, 1991. Respondent's default was entered and the panel determined that the default established the allegations of the formal complaint.

Respondent was suspended from the practice of law in Michigan for a period of 75 days effective February 9, 1990, Case Nos. ADB 71-89; 82-89. Respondent has not been reinstated from that suspension. Respondent failed to pay the costs assessed in that order of discipline; failed to file an affidavit of compliance with MCR 9.119; failed to make restitution as ordered; practiced law while suspended; and failed to answer two requests for investigation.

Respondent's conduct was found to be in violation of MCR 9.104 (1-4,7,9); MCR 9.103(C); MCR 9.113(B)(2); MCR 9.119(A-C); MCL 600.916, MSA 27A.916; and the Michigan Rules of Professional Conduct, 1.16(a)(1); 5.5(a); 8.1(b); 8.4(a-c).

The panel issued an order of revocation of September 13, 1991. Respondent filed a petition for review seeking a decrease in the discipline imposed, stating that he received neither the requests for investigation nor the formal complaint. In an order issued on February 24, 1992, the Attorney Discipline Board remanded this matter to the hearing panel to conduct a hearing on the level of discipline to be imposed.

Upon consideration of the mitigating factors presented, the hearing panel reduced discipline to an 18-month suspension commencing October 5, 1991, the effective date of the panel's order of revocation. Costs were assessed in the amount of $443.91.
