NOTICE OF REPRIMAND (By Consent)
Case No. 90-191-GA William D. Foren, P24226, Farmington, Michigan, by Attorney Discipline Board Tri-County Hearing Panel #60.
1) Reprimand; 2) Effective June 7, 1991. The respondent and the grievance administrator filed a stipulation for consent order of discipline pursuant to MCR 9.115 (F)(5) which was approved by the hearing panel and the Attorney Grievance Commission. Respondent was representing a jewelry company on a collection of outstanding indebtedness owed to the jewelry company from its customers, but failed to deal fairly and honestly with all judgment debtors; failed to promptly account for and deliver to judgment debtors any monies he collected in excess of the amount(s) due to respondent's client; and failed to refrain from harassing or maliciously causing injury to judgment debtors. Respondent's conduct was found to be in violation of MCR 9.104 (1-4), Canons 1 and 7 of the Code of Professional Responsibility, DR 1-102(A)(1,4-6); DR 7-102(A)(1); and the Michigan Rules of Professional Conduct, 8.4(a,c). Costs were assessed in the amount of $77.40.
