NOTICE OF SUSPENSION Case Nos. 90-84-GA; 90-104-FA Samuel V. Thomas, P26693, Detroit, Michigan, by the Attorney Discipline Board affirming a hearing panel order of suspension.

1) Suspension - sixty (60) days; 2) Effective June 7, 1991. The hearing panel found that the allegations of misconduct in formal complaint 90-84-GA, count I(C)(i-iv) were established by a preponderance of the evidence. Count I(C)(v) and count II were dismissed. Respondent was retained to represent an individual in a worker's compensation matter, but failed to appear for trial twice, failed to respond to the inquiries of his client and failed to notify his client of court dates. Respondent's conduct was found to be in violation of MCR 9.104(1-4); Canons 1, 6 and 7 of the Code of Professional Responsibility, DR 1-102(A)(1,5,6); DR 6-101(A)(3); DR 7-101(A)(1-3); and the Michigan Rules of Professional Conduct, 1.1(c); 1.3; 1.4(a,b); 8.4(a,c).

Respondent filed a petition for review seeking reversal of the hearing panel order suspension. In an order dated May 16, 1991, the Attorney Discipline Board affirmed the hearing panel order of suspension. Costs were assessed in the amount of $640.09.
