NOTICE OF SUSPENSION Case Nos. 90-158-GA; 90-162-FA V. Mosser Dunn, P13028, Detroit, Michigan, by Attorney Discipline Board Tri-County Hearing Panel #53.

1) Suspension - 120 days; 2) Effective April 4, 1991. Respondent failed to answer the formal complaints, but appeared at the hearing held in Southfield on December 10, 1990. Respondent's defaults were entered, and the panel determined that the defaults established the allegations of the formal complaints. Respondent was retained to institute a probate matter and was paid a retainer of $250.00, but failed to institute any proceedings on behalf of his client, failed to answer the inquiries of his client, failed to return the unused portion of his attorney fee, and failed to answer the request for investigation. Respondent's conduct was found to be in violation of MCR 9.104(1-4,7); MCR 9.103(C); MCR 9.113(B)(2); and the Michigan Rules of Professional Conduct, 1.1(c); 1.16(d); 1.2(a); 1.3; 3.2; and 8.4(a-c). Costs were assessed in the amount of $133.87.
