1) Revocation; 2) Effective April 19, 1991. Respondent failed to answer the formal complaint and failed to appear at the hearing held in Bloomfield Hills on March 28, 1991. Respondent's default was entered and the hearing panel determined that the default established the allegations of formal complaint 91-25-GA. Formal complaint 91-42-FA was dismissed without prejudice.
The eighteen count formal complaint contained one count of misappropriation, six counts of neglect, three counts of misrepresentation to a client and/or client's subsequent counsel, two counts of failure to answer requests for investigation, one count of failure to timely answer a request for investigation, two counts of conflict of interest, one count of giving a client a check drawn on insufficient funds, one count of failure to return a client's file, and one count of failure to return an unearned fee.
Respondent's conduct was found to be in violation of MCR 9.104 (1-6); MCR 9.113(A) and (B)(2); Canons 1, 6, 7 and 9 of the Code of Professional Responsibility, DR 1-102(A)(1,4-6); DR 6-101(A)(3); DR 7-101(A)(1-3); DR 9-102(B)(4); and the Michigan Rules of Professional Conduct, 1.1(b,c); 1.2(a); 1.3; 1.4(a,b); 1.8(a)(1-3); 1.15(a,b); 1.16(d); 4.1(a,b); 8.1(b); 8.4(a-c). Costs were assessed in the amount of $204.85.
