NOTICE OF SUSPENSION Case No. DP 66/85 Frederick A. Patmon, P18695, Detroit, Michigan, by the Attorney Discipline Board affirming a hearing panel order of suspension.

1) Suspension - ninety (90) days; 2) Effective May 31, 1991. The hearing panel found that the evidence established that the respondent held funds entrusted to him by a client to be used for an investment in a limited partnership. The funds were not used to discharge the client's obligations as a limited partner. Although the client requested the return of those funds, the respondent kept the funds without authorization. The respondent's conduct was alleged by the Grievance Administrator to be in violation of GCR 953(1-4) [now MCR 9.104(1-4)] and Canons 1 and 9 of the Code of Professional Responsibility, DR 1-102(A)(4-6) and DR 9-102(B)(4).

The respondent filed a petition for review seeking relief from the hearing panel order of suspension, including but not limited to a decrease in the discipline imposed. In an order and opinion entered May 14, 1990, the Attorney Discipline Board affirmed the hearing panel order of suspension. Respondent's motion for reconsideration was denied by the Board in an order dated August 14, 1990. Respondent's application for leave to appeal and motion for stay were denied by the Michigan Supreme Court on May 31, 1991. Costs were assessed in the amount of $6826.87.
