NOTICE OF SUSPENSION AND RESTITUTION Case No. 90-153-GA David S. Grant, Jr., P29252, Gardena, California (formerly of Flint, Michigan), by the Attorney Discipline Board affirming a hearing panel order of suspension and restitution.
1) Suspension - thirty (30) days; 2) Effective May 10, 1991. The hearing panel found that respondent was retained to perfect an appeal in a criminal matter and was paid a retainer of $3000, but failed to file the appeal and failed to return the unused portion of the retainer fee. Respondent's conduct was found to be in violation of MCR 9.104(1-4) and the Michigan Rules of Professional Conduct, 1.1(c); 1.2(a); 1.3; 1.16(d); 3.2; and 8.4(a). The panel ordered respondent to make restitution to his client in the amount of $2000. Costs were assessed in the amount of $299.78.
The Grievance Administrator filed a petition for review seeking an increase in the discipline imposed. In an order dated July 23, 1991, the Attorney Discipline Board affirmed the hearing panel order of suspension and restitution.
