1) Reprimand; 2) Effective May 24, 1991. The hearing panel found that misconduct as alleged in the formal complaint was established by a preponderance of the evidence. Respondent was retained as substitute counsel for the defendant in divorce proceedings, but directly communicated with the plaintiff concerning a proposed settlement without the consent of plaintiff's counsel. Respondent's conduct was found to be in violation of MCR 9.104(1-4) and the Michigan Rules of Professional Conduct, 4.2 and 8.4(a,c). Costs were assessed in the amount of $517.15.
