1) Suspension - sixty (60) days; 2) Effective March 1, 1991. Based upon the respondent's admissions, the hearing panel concluded that the allegations contained in Count II of Formal Complaint 90-37-GA were established. The balance of the counts of that complaint were dismissed; Formal Complaint 90-55-FA was also dismissed. Respondent was retained to prosecute civil litigation to recover an automobile, but falsely told his client that he had filed a complaint on the client's behalf. Respondent's conduct was found to be in violation of MCR 9.104(1-4); Rule 8.4(a-c) of the Michigan Rules of Professional Conduct and Canon 1 of the Code of Professional Responsibility, DR 1-102(A)(1,4-6). Costs were assessed in the amount of $1696.85.
