NOTICE OF REVOCATION (By Consent)

Case Nos. 91-29-GA; 91-31-JC Paul M. Bunin, P11381, Southfield, Michigan, by Attorney Discipline Board Tri-County Hearing Panel #85.

1) Revocation; 2) Effective February 6, 1991. The two separate matters were consolidated by stipulation of the parties and order of the Attorney Discipline Board. The respondent and the grievance administrator filed a stipulation for consent order of discipline pursuant to MCR 9.115(F)(5) which was approved by the hearing panel and the Attorney Grievance Commission.

Respondent admitted the allegations of misconduct contained in formal complaint 91-29-GA. Respondent was retained to prosecute an action to quiet title. He was paid a retainer fee of $1,000 and he received $200 for costs, but failed to commence action on his clients' behalf, failed to refund the retainer fee and costs, and prepared fraudulent documents to conceal his failure to take action. Respondent's conduct was found to be in violation of MCR 9.104(1-4); Canons 1, 6 and 7 of the Code of Professional Responsibility, DR 1-102(A)(1,5,6); DR 6-101(A)(3); DR 7-101(A) (1-3); and the Michigan Rules of Professional Conduct, 1.1(c); 1.2(a); 1.3; 1.4(a); 8.4(a-c).

Respondent pleaded guilty in the United States District Court for the Eastern District of Michigan to two counts of bank fraud in violation of 18 USC 1344. In accordance with MCR 9.120(A)(1), respondent's license to practice law in Michigan was automatically suspended on February 6, 1991, the date of conviction.

In an order issued June 20, 1990, the hearing panel accepted the stipulation for consent order of discipline and ordered that respondent's license to practice law in Michigan be revoked effective February 6, 1991. Costs were assessed in the amount of $234.37.
