NOTICE OF PROBATION ADB 153-88; 183-88 Richard W. Bohan, P10950, Detroit, Michigan, by the Attorney Discipline Board.

1) Probation - two years; 2) Effective April 8, 1991. The respondent was charged, in two separate complaints, with neglecting legal matters entrusted to him by three separate clients; failing to respond to his clients' inquiries; failing to return unearned legal fees; and failing to answer three Requests for Investigation. The respondent's conduct was alleged to be in violation of MCR 9.104(1-4); MCR 9.113(B)(2) and Canons 1, 2, 6 and 7 of the Code of Professional Responsibility, DR 1-102-(A)(1,5,6); DR 2-110(A)(3); DR 6-101(A)(3) and DR 7-101(A)(1-3).

In conjunction with delayed petitions for review filed with the Attorney Discipline Board in two other cases involving similar misconduct, the respondent asserted in mitigation that his conduct was substantially cause by an impairment which had been diagnosed and which was susceptible to treatment. The consolidated matters were referred to a special master appointed by the Board for the purpose of receiving evidence pertaining to the respondent's eligibility for an order of probation under the guidelines of MCR 9.121(C). Based upon the master's recommendations, respondent is placed on probation for a period of two years subject to medical and professional supervision. In a supplemental order, costs in the consolidates matters were assessed in the total amount of $2394.77.
