NOTICE OF REPRIMAND (By Consent)

Case No. 18-87-GA

Notice Issued: November 21,2018

Robert Kurtycz, P 71637, Kalamazoo, Michigan, by the Attorney Discipline Board Allegan County Hearing Panel #1.

Reprimand, Effective November 21, 2018

The respondent and the Grievance Administrator filed a Stipulation for Consent Order of Discipline, in accordance with MCR 9.115(F)(5), which was approved by the Attorney Grievance Commission and accepted by the hearing panel. The stipulation contained respondent's plea of no contest to the allegations that he committed acts of professional misconduct in his representation of a client in a landlord/tenant dispute when he engaged in uncivil communications with opposing counsel and his staff and that he listed misleading information regarding his office locations on his website.

Based upon respondent's plea and the stipulation of the parties, the panel found that respondent failed to treat all persons involved in the legal process with courtesy and respect, in violation of MRPC 6.5(a); and used or participated in the use of a public communication that was false, fraudulent or misleading, in violation of MRPC 7.1. Respondent was also found to have violated MCR 9.104(2) and (3).

In accordance with the stipulation of the parties, the panel ordered that respondent be reprimanded. Costs were assessed in the amount of $798.90.
