1) Suspension - thirty-one days; 2) Effective November 21, 1990. The respondent was retained to represent an individual in an action for personal injury, and a settlement was entered in the amount of $14,000.00. Respondent disbursed the proceeds pursuant to the retainer agreement and deducted attorney fees and costs. Respondent failed to pay one item in the amount of $666.00 as agreed, either to his client or to the medical clinic to which it was owed.
The hearing panel found the respondent's conduct to be in violation of MCR 9.104(1-4) and Canons 1 and 9 of the Code of Professional Responsibility, DR 1-102(A)(1,6); DR 9-102(B)(3,4). Costs were assessed in the amount of $331.04.
