NOTICE OF SUSPENSION Case Nos. 90-33-GA; 90-53-FA; 90-133-GA; 90-144-FA Tat Parish, P-18636, St. Joseph, Michigan, by Attorney Discipline Board Kalamazoo County Hearing Panel #2.

1) Suspension - ninety days; 2) Effective November 16, 1990. The respondent failed to answer the formal complaints, but appeared at the hearing held in Paw Paw on October 1, 1990. Respondent's defaults were entered and the hearing panel determined that the defaults established the allegations of the formal complaints.

Respondent was retained to prosecute a civil action, but failed to prosecute the action, failed to keep his clients abreast of the status of the matter, failed to respond to their inquiries, and failed to answer the request for investigation.

The respondent represented a client in a matter in Berrien County Circuit Court, but failed to file responses to interrogatories, failed to advise his client of a scheduled deposition, failed to file a written response to defendant's motion to dismiss, failed to appear for hearing, and failed to respond to a supplemental request for information from the Attorney Grievance Commission. Respondent was retained to represent a another client in a matter in Berrien County Circuit Court, but failed to prosecute the matter, failed to respond to his client's inquiries, and failed to timely answer the request for investigation. Respondent failed to answer an separate unrelated request for investigation.

Respondent's conduct was found to be in violation of MCR 9.104(1-4,7); MCR 9.103(C); MCR 9.113(A); MCR 9.113(B)(2); Canons 1, 6 and 7 of the Code of Professional Responsibility, DR 1-102(A)(1,5,6); DR 6-101(A)(3); DR 7-101(A)(1-3); and the Michigan Rules of Professional Conduct, 1.1(c); 1.3; 1.4(a,b); 8.4(a-c). Costs were assessed in the amount of $518.66.
