NOTICE OF SUSPENSION Case Nos. 90-101-GA; 90-111-FA Richard E. Rosenberg, P-33902, Lincoln Park, Michigan, by the Attorney Discipline Board dismissing respondent's petition for review.
1) Suspension - 30 days; 2) Effective December 19, 1990. The respondent failed to answer the formal complaints, but appeared at the hearing held in Detroit on July 18, 1990. Respondent's default was entered, and the panel determined that the default established the allegations of the formal complaints.
Respondent was retained in connection with a discrimination suit, but failed to appear for a settlement conference, failed to respond to the inquiries of his client, and failed to answer the request for investigation.
Respondent's conduct was found to be in violation of MCR 9.104(1-4,7); MCR 9.113(A); MCR 9.113(B)(2); and the Michigan Rules of Professional Conduct, 1.1(c); 1.3; 1.4; 8.4(a-c). Costs were assessed in the amount of $260.90.
The respondent filed a petition for review seeking modification of the order of discipline. In an order dated November 26, 1990, the Attorney Discipline Board dismissed respondent's petition for review for his failure to appear at the review hearing or timely file a brief in support of the petition for review.
