NOTICE OF SUSPENSION AND RESTITUTION Case No. 90-148-GA Jean D. Artman, P-28347, Detroit, Michigan, by Attorney Discipline Board Tri-County Hearing Panel #17.

1) Suspension - nine months; 2) Effective January 1, 1991. The respondent failed to answer the formal complaint and failed to appear at the hearing held in Detroit on October 29, 1990. Respondent's default was entered and the hearing panel determined that the default established the allegations of the formal complaint.

Respondent engaged in the practice of law in violation of previous orders of suspension as follows: While suspended, the respondent was retained to represent an individual in a divorce matter, accepted a $500.00 fee, filed an answer to the complaint bearing the purported signature of another attorney, entered an appearance as attorney of record, and failed to inform her client, the tribunal and all parties in the divorce matter of her suspension. Respondent failed to answer the request for investigation.

Respondent's conduct was found to be in violation of MCR 9.104(1-4,7,8); MCR 9.113(B)(2); MCLA 600.916, MSA 27A.916; and the Michigan Rules of Professional Conduct, 1.5(1); 3.3(a)(1); 5.5(a); 8.1(b); 8.4(a-c). The panel ordered the respondent to make restitution to her client in the amount of $500.00. Costs were assessed in the amount of $106.45.
