NOTICE OF REPRIMAND (By Consent)
ADB 183-89; 90-6-FA Gordon W. Brennan, P-36319, Lansing, Michigan, by Attorney Discipline Board Livingston County Hearing Panel.
1) Reprimand; 2) Effective August 28, 1990. The respondent and the Grievance Administrator filed a stipulation for consent order of discipline pursuant to MCR 9.115(F)(5) which was approved by the hearing panel and the Attorney Grievance Commission. The respondent offered his plea of nolo contendere to the charges contained in Formal Complaint 183-89.
Respondent was retained to prosecute a dental malpractice matter, but failed to file suit, failed to communicate with his client, failed to respond to his client's inquiries, failed to notify his client of a suspension from a previous disciplinary matter, and failed to answer the request for investigation. Formal Complaint 90-6-FA was dismissed by stipulation of the parties.
Respondent's conduct was found to be in violation of MCR 9.104(1-4); MCR 9.103(C); MCR 9.113(B)(2); MCR 9.119(A); and Rules 1.1(c); 1.2(a); 1.3; 1.4(a); 1.16(a)(1); 8.1(b) and 8.4(a,c) of the Michigan Rules of Professional Conduct. Costs were assessed in the amount of $65.50.
