NOTICE OF REPRIMAND (By Consent)
ADB 174-89 Ronald Derocher, P-35042, Kalkaska, Michigan, by Attorney Discipline Board Wexford County Hearing Panel.
1) Reprimand; 2) Effective June 13, 1990. The respondent and the Grievance Administrator filed a stipulation for consent order of discipline pursuant to MCR 9.115(F)(5) which was approved by the hearing panel and the Attorney Grievance Commission.
The respondent admitted that he failed to provide legal services as appointed counsel by failing to file a timely appeal of a felony conviction, as alleged in Count VI of the complaint. The balance of the counts in the formal complaint were dismissed with prejudice.
Respondent's conduct was found to be in violation of MCR 9.104(1-4) and Canons 1, 2, 6 and 7 of the Code of Professional Responsibility, DR 1-102(A)(3); DR 6-101(A)(2,3); DR 7-101(A)(3). The order of reprimand places certain limits on the respondent's practice. Costs were assessed in the amount of $64.15.
