NOTICE OF SUSPENSION (By Consent)

Case No. 90-82-GA Richard C. Digon, P-35838, Ypsilanti, Michigan by Attorney Discipline Board Washtenaw County Hearing Panel #2.

1) Suspension - 180 days; 2) Effective September 29, 1990. The Grievance Administrator and the respondent filed a Stipulation for Consent Order of Discipline in accordance with MCR 9.115(F)(5). The stipulation was accepted by the Attorney Grievance Commission and a hearing panel.

The respondent offered a plea of nolo contendere to a charge that he failed to represent his client diligently, failed to further his client's lawful objectives and failed to avoid prejudicing or damaging his client as court-appointed counsel in a criminal matter by failing to reclaim his client's right to oral argument in the Court of Appeals and by failing to timely advise his client that the conviction had been affirmed.

Respondent's conduct was deemed to be in violation of MCR 9.104(1-4) and Canons 1, 6 and 7 of the Code of Professional Responsibility, DR 1-102(A)(1,5-6); DR 6-101(A)(3) and DR 7-101(A) (1-3). Costs were assessed in the amount of $157.95.
