1) Reprimand; 2) Effective June 30, 1990. The respondent was the attorney for the defendant in a Wayne County Circuit Court action. Respondent met with the opposing party plaintiff without providing notice to or obtaining consent from plaintiff's attorney. Respondent presented a letter to the plaintiff for her signature. The letter stated that the plaintiff did not want to pursue the litigation, instructed plaintiff's attorney to prepare documents dismissing the litigation, and discharged plaintiff's attorney. Respondent did not advise the plaintiff to obtain the advice of independent counsel concerning the letter.
The hearing panel unanimously concluded that respondent's conduct was in violation of MCR 9.104(1-4) and Rules 4.2 and 8.4(a,c) of the Michigan Rules of Professional Conduct. Costs were assessed in the amount of $1052.90.
