NOTICE OF REPRIMAND ADB 171-89; 181-89 Robert J. Devyak, P-12734, Northville, Michigan, by the Attorney Discipline Board affirming a hearing panel order of reprimand.

1) Reprimand; 2) Effective July 18, 1990. The hearing panel found that misconduct had been established by a preponderance of the evidence as to Count II of ADB 171-89; Count I was dismissed. Respondent's default was set aside. Formal Complaint ADB 181-89, filed for the respondent's failure to timely answer ADB 171-89, was dismissed. Respondent failed to answer a request for investigation. Respondent's conduct was found to be in violation of MCR 9.104(1-4,7); MCR 9.103(C); MCR 9.113(B)(2); and the Michigan Rules of Professional Conduct, 8.4(a,b,c).

The Grievance Administrator filed a petition for review regarding the panel's decision to set aside the default and dismiss the second formal complaint, and seeking an increase in the discipline imposed. In an order dated October 1, 1990, the Attorney Discipline Board reversed the hearing panel dismissal of ADB 181-89 and affirmed the hearing panel order of reprimand. Costs were assessed in the amount of $623.10.
