1) Suspension - 120 days; 2) Effective July 13, 1990. The respondent was appointed to represent thirteen separate individuals in criminal appeals. The hearing panel found that the respondent failed to timely file claims for appeal in twelve of those thirteen matters, and failed to file a motion to set aside guilty plea in one of the matters. Respondent failed to timely answer the formal complaint.
Respondent's conduct was found to be in violation of MCR 9.104(1,2,4); MCR 9.115(D); Canons 1, 6 and 7 of the Code of Professional Responsibility, DR 1-102(A)(1,5); DR 6-101(A)(3); DR 7-101(A)(1-3); and the Michigan Rules of Professional Conduct, 1.1(c); 1.3; 8.4(a,c).
Costs were assessed in the amount of $398.79.
