NOTICE OF SUSPENSION Case No. 90-60-GA Steven Mazzetti, P29776, Hazel Park and Ortonville, Michigan, by the Attorney Discipline Board affirming a hearing panel order of suspension.

1) Suspension - two (2) years and eleven (11) months; 2) Effective July 12, 1990. Based on the respondent's admissions in his answer to the formal complaint, the panel found that the allegations in the formal complaint had been established. Respondent was retained to probate an estate and to forward the decedent's medical records to a specific law firm for evaluation as to medical malpractice, but failed to file an accounting of the estate within the statutory period, failed to refer the decedent's medical records to the specified law firm, made misrepresentations to his client regarding the status of the matter, and provided his client with a falsified court order and with two falsified letters purportedly from the law firm which was to have received the medical records. Respondent's conduct was found to be in violation of MCR 9.104(1-5); Canons 1, 6 and 7 of the Code of Professional Responsibility, DR 1-102(A) (1,3-6); DR 6-101(A)(3); DR 7-101(A)(1-3); and the Michigan Rules of Professional Conduct, 1.1(c); 1.2(a); 1.3; 1.4(a); 8.4(a-c). On February 6, 1991, the hearing panel entered an order suspending respondent's license for a period of two years and eleven months, retroactive to July 12, 1990, the date of the hearing.

The complainant filed a petition for review seeking an increase in the discipline imposed. Respondent filed a cross- petition for review seeking further retroactivity of the effective date of the suspension. In an order dated August 1, 1991, the Attorney Discipline Board, by majority, affirmed the hearing panel order of suspension. A dissenting board member voted to increase discipline to revocation. Costs were assessed in the amount of $502.75.
