NOTICE OF SUSPENSION (By Consent)

Case No. 90-7-GA Bradley P. Driscoll, Jr., P-12962, Mt. Clemens, Michigan by Attorney Discipline Board Tri-County Hearing Panel #102.

1) Suspension - three years and one day; 2) Effective June 16, 1990. The Grievance Administrator and the respondent filed a Stipulation for Consent Order of Discipline in accordance with MCR 9.115(F)(5) which was accepted by the Attorney Grievance Commission and a hearing panel.

The respondent offered his plea of nolo contendere to the allegations in the complaint that he failed to maintain an account for the sum of $2260 entrusted to him as personal representative of a decedent's estate, that he paid himself a fee as personal representative without the consent of the heirs or the probate court, that he failed to turn over files and records to a successor fiduciary, and that he neglected to file an annual account with the probate court.

Respondent's conduct was alleged to be in violation of MCR 9.104(1-4) and Canons 1, 6, 7 and 9 of the Code of Professional Responsibility, DR 1-102(A)(1,4-6), DR 6-101(A)(3), DR 7-101(A)(1- 3), DR 9-102(A) and DR 9-102(B)(2-4).
