NOTICE OF INCREASED SUSPENSION AND RESTITUTION ADB 138-89; 154-89; 156-89; 163-89 G. Michael Doroshewitz, P-34717, Plymouth, Michigan, by the Attorney Discipline Board increasing a hearing panel order of suspension.

1) Suspension - 180 days; 2) Effective February 14, 1990. The respondent failed to timely answer the first formal complaint and failed to answer the following three, but appeared at the hearing held in Detroit on November 28, 1989. Respondent's defaults were entered and the hearing panel determined that the defaults established the allegations of the formal complaints.

Respondent was retained in five separate divorce actions, but failed to perform services for his clients, failed to communicate with his clients, and failed to refund the retainer fees.

Respondent was retained to have a client's operator's license restored, but failed to perform services for his client, failed to advise his client of the status of his efforts, and failed to refund the retainer.

Respondent was retained to modify a judgment for divorce, but failed to enter an order and failed to communicate with his client. The respondent also failed to answer six requests for investigation.

The hearing panel ordered the respondent to make restitution to six of his clients in the total amount of $2179.00. Respondent's conduct was found to be in violation of MCR 9.103(C); MCR 9.104(1- 4,7); MCR 9.113(B)(2); the Michigan Rules of Professional Conduct 1.1(c); 1.2(a); 1.4(a); 1.16(d); 8.4(a); and Canons 1, 2, 6 and 7 of the Code of Professional Responsibility, DR 1-102(A)(1,5,6); DR 2-110(A)(3); DR 6-101(A)(3); and DR 7-101(A)(1,2).

The Grievance Administrator filed a petition for review seeking an increase in the 120 day suspension ordered by the panel. In an order dated July 3, 1990, the Attorney Discipline Board increased discipline to a suspension of 180 days. Total costs were assessed in the amount of $270.56.
