1) Suspension - 180 days; 2) Effective April 6, 1990. The respondent failed to answer the formal complaints, but appeared at the hearing held in Detroit on April 6, 1990. Respondent's defaults were entered and the hearing panel determined that the defaults established the allegations of the formal complaints.
Respondent was retained in a divorce action but failed to serve a complaint for divorce which had been filed, failed to notify his client that the court had dismissed the action, failed to obtain an extension of the time during which the summons may be served, failed to communicate with his client as to the status of the file, and failed to answer the request for investigation.
Respondent's conduct was found to be in violation of MCR 9.104(1-4,7); MCR 9.103(C); MCR 9.113(B)(2); and the Michigan Rules of Professional Conduct 1.1(a,c); 1.2(a); 1.3; 3.2; and 8.4(a-c). The hearing panel ordered the respondent to make restitution to his client in the amount of $300.00. Costs were assessed in the amount of $183.20.
