NOTICE OF SUSPENSION DP 51/86; ADB 2-87 Thomas L. E. Stanley, P-26060, Detroit, Michigan, by the Attorney Discipline Board affirming a hearing panel order of suspension.

1) Suspension - 30 days; 2) Effective March 20, 1990. The respondent failed to timely answer or seek an extension of time to answer Formal Complaint DP 51/86. The hearing panel concluded that the respondent's conduct was in violation of MCR 9.115(D). Hearing panel costs were assessed in the amount of $1373.16.

Following consideration of a petition for review filed by the respondent, the suspension imposed by the hearing panel was affirmed an order issued by the Attorney Discipline Board on December 16, 1988. The Board found that the respondent's argument that setting aside of a default complaint precludes a subsequent finding that the failure to answer the complaint constituted professional misconduct is without merit. Additional costs for the ap*peal hearing were assessed in the amount of $73.13, for a grand total of $1446.29.

A motion for reconsideration was filed by the respondent. In an order dated June 29, 1989, the Attorney Discipline Board denied the respondent's motion for reconsideration. The respondent filed an application for leave to appeal with the Michigan Supreme Court. The Supreme Court denied the respondent's application for leave to appeal in an order dated March 20, 1990.
