NOTICE OF SUSPENSION ADB 189-87 Paul R. Jackman, P-15370, Harper Woods, Michigan, by the Attorney Discipline Board vacating a hearing panel order of probation and restitution.
1) Suspension - thirty days; 2) Effective February 7, 1990. The respondent was appointed guardian and conservator of an estate by the Wayne County Probate Court. The hearing panel found that he commingled his personal funds with those belonging to the estate, and issued a check from his client's trust account in payment of his Bar dues.
Respondent's conduct was found to be in violation of MCR 9.104(1-4), and the Code of Professional Responsibility, DR 9-102(A). The panel unanimously determined that the respondent be placed on probation for a period of one year with certain conditions, and make restitution to the estate in the amount of $500.00.
Upon consideration of a petition for review filed by the Grievance Administrator, the Attorney Discipline Board affirmed the factual findings of the panel. By majority, the Board concluded that those findings warranted modification of the order of discipline to a suspension of thirty days. One dissenting Board member voted to impose a suspension of at least one year. Another dissenting member voted to affirm the order of probation. Costs were assessed in the amount of $1575.76.
