NOTICE OF PROBATION (By Consent)

ADB 259-88 Samuel V. Thomas, P-26693, Detroit, Michigan by Attorney Discipline Board Wayne County Hearing Panel #25.

1) Probation - one year; 2) Effective February 1, 1990. The hearing panel accepted a stipulation for consent discipline filed in accordance with MCR 9.115(F)(5) in which the respondent offered his pleas of nolo contendere to the charges contained in the Formal Complaint. Respondent was retained to prosecute an employment discrimination matter. He issued a check to the Court that was dishonored, failed to pay the filing fees causing dismissal of the case, and failed to inform his client of the dismissal. Respondent's conduct was found to be in violation of MCR 9.104(1-4) and Canons 1, 6 and 7 of the Code of Professional Responsibility, DR 1-102(A)(1,5,6); DR 6-101(A)(3); and DR 7-101(A) (1-3).

Respondent's probation will be consecutive to a two-year period of probation which became effective February 1, 1988 in accordance with a consent order of probation entered by Oakland County Hearing Panel #30 in ADB 232-87 (see Notice dated February 9, 1989). Costs were assessed in the amount of $69.57.
