1) Revocation; 2) Effective December 28, 1989. The respondent failed to answer the formal complaints and failed to appear at the hearing held in Detroit on October 26, 1989. Respondent's defaults were entered and the hearing panel determined that the defaults established the allegations of the formal complaints. Respondent was charged with four counts of commingling, five counts of misappropriation, seven counts of neglect, two counts of improper withdrawal from employment, two counts of failure to return unearned fees, and eleven counts of failure to answer requests for investigation. The hearing panel ordered the respondent to make restitution Co six clients in the total amount of $81,030.53. Respondent's conduct was found to be in violation of MCR 9.104(1-4,7); MCR 9.103(C); MCR 9.113 (B)(2); Canons 1, 2, 6, 7 and 9 of the Code of Professional Responsibility, DR 1-102(1,3-6); DR 2-110(A)(2,3); DR 6-101(A) (3); DR 7-101(A)(1-3); DR 9-102(A)(B)(4); and the Michigan Rules of Professional Conduct 1.1(c); 1.2(a); 1.3; 1.16(d); and 8.4(a,b,c). Costs were assessed in the amount of $263.95.
