NOTICE OF SUSPENSION ADB 56-89; 80-89 Jeffery T. Ross, P-32289, Traverse City, Michigan, by the Attorney Discipline Board vacating a hearing panel order of reprimand.

1) Suspension - 60 days; 2) Effective November 16, 1989. The respondent failed to answer the formal complaints, but appeared at the hearings held in Traverse City on July 27 and August 25, 1989. Respondent's default was entered and the hearing panel determined that the default established the allegations of the formal complaint.

Respondent was suspended from the practice of law in Michigan for a period of 45 days effective October 22, 1988 (ADB 149-88; 164-88). Respondent violated that order of suspension by appearing at a hearing on behalf of the defendant on November 4, 1988, failed to notify all active clients of his suspension, failing to file proof that he had notified clients of his suspension, and failed to file notice of his suspension with the tribunals and parties in matters in which he appeared as an attorney. Respondent failed to answer the request for investigation.

Respondent's conduct was found to be in violation of MCR 9.104(1-4,7,8); MCR 9.103(C); MCR 9.113(B)(2); MCLA 600.916; MSA 27A.916; and Rules 5.5(a) and 8.4(a-c) of the Michigan Rules of Professional Conduct.

The Grand Traverse County Hearing Panel ordered that the respondent be reprimanded.

The Grievance Administrator filed a petition for review seeking an increase in the discipline imposed. In an order dated May 7, 1990, the Attorney Discipline Board vacated the hearing panel order of reprimand and ordered that the respondent's license to practice law in the State of Michigan be suspended for a period of sixty days effective November 16, 1989.

Costs were assessed in the amount of $773.94. An affidavit of compliance pursuant to MCR 9.123(A) was filed with the Supreme Court regarding ADB 56-89; 80-89; no such affidavit has been filed in ADB 149-88; 164-88.
