NOTICE OF SUSPENSION (By Consent)

1) Suspension - Three years/one day; 2) Effective December 27, 1989. The respondent and the Grievance Administrator submitted a Stipulation for Consent Order of Discipline which was approved by the Attorney Grievance Commission and a hearing panel in accordance with MCR 9.115(F)(5). The panel accepted the respondent's plea of no contest to charges that the respondent was entrusted with funds belonging to a decedent's estate in his capacity as personal representative but misappropriated assets of the estate, filed an amended inventory which was false with respect to the existence of certain certificates of deposit, and commingled personal funds with funds belonging to the estate. The respondent's conduct was alleged to be in violation of MCR 9.104(1-4) and Canons 1 and 9 of the Code of Professional Responsibility, DR 1-102(A)(4-6); DR 9-102(A), DR 9-102(B)(1,3,4). Costs were assessed in the amount of $478.82.
