NOTICE OF SUSPENSION AND RESTITUTION AMENDED ORDER BY CONSENT

ADB 74-89; 86-89 W. Bruce Simpson, P-20518, Sterling Heights, Michigan, by Attorney Discipline Board Macomb County Hearing Panel #6.

1) Suspension - 60 days; 2) Effective October 21, 1989. The respondent was charged with neglect of a legal matter entrusted to him by a client, failed to answer the formal complaints, failed to answer the Requests for Investigation or to appear at a hearing held in Macomb County. The panel determined that misconduct had been established by virtue of the default and entered its order suspending the respondent from the practice of law for a period of sixty days.

Following an appeal filed by the Grievance Administrator of the panel's order, the Board issued an order remanding this matter to the hearing panel for a supplemental report on discipline.

The respondent and the Grievance Administrator entered into a Stipulation for Amended Order of Discipline, by consent. The 60-day suspension and the effective date remained unchanged. Conditions of the consent agreement included a provision requiring the respondent to make restitution in the amount of $621.00 to the complainant, that he attend at least three alcohol abuse meetings per week for a period of one year, and that he file an affidavit with both discipline agencies stating that he has complied with the terms of the consent order of discipline. Costs were assessed in the amount of $117.00. (See Notice of Suspension and Restitution dated October 23, 1989.)
