1) Suspension - one year; 2) September 6, 1989. The respondent failed to answer the formal complaint and failed to appear at a hearing before Wayne County Hearing Panel #11 on June 15, 1989. The panel concluded that the respondent's default established the allegations in the complaint that the respondent was automatically suspended from the practice of law effective June 12, 1988 for failure to pay his annual dues to the State Bar of Michigan in accordance with Rule 4(B) of the Supreme Court Rules concerning the State Bar. The respondent failed to notify his clients of his change of status, continued to engage in the practice of law and failed to answer a Request for Investigation, all in violation of MCR 9.104(1-4,7); MCR 9.103(C); MCR 9.113(B), Canon 1 of the Code of Professional Responsibility, DR 1-102(A)(1,5,6) and the Michigan Rules of Professional Conduct 8.4(a,c). The hearing panel noted the respondent's prior discipline including a suspension of 180 days effective October 22, 1988 and a suspension of 120 days effective November 4, 1988. Costs were assessed in the amount of $83.50.
