NOTICE OF REVOCATION ADB 76-89 Robert L. Malmsten, P-32643, Southgate MI by Attorney Discipline Board Wayne County Hearing Panel #2.

1) Revocation; 2) Effective September 22, 1989. The respondent failed to answer the formal complaint and failed to appear at a hearing before Wayne County Hearing Panel 112 on July 24, 1989. The panel concluded that the respondent's default constituted his admissions to the allegations in the complaint that he was retained in 1987 to instituted forfeiture proceedings in a real estate matter but that he abandoned his representation of the client without notice and he failed to answer a Request for Investigation. Respondent#s conduct was found to be in violation of MCR 9.104(1-4,7); MCR 9.103(C); MCR 9.113(B)(2), Canons 1, 6 and 7 of the Code of Professional Responsibility, DR 1-102(A)(5,6); DR 6-101(A)(3); DR 7-101(A)(1-3) and the Michigan Rules of Professional Conduct, Rule 8.4(a,c). The hearing panel report recited the respondent#s prior suspensions which had become effective at the time of the hearing: Suspension of 180 days effective October 22, 1989, suspension of 120 days effective November 4, 1988 and a suspension of two years effective July 11, 1989. Cost were assessed in the amount of $83.50.
