1) Suspension - sixty days; 2) Effective November 27, 1989. The respondent failed to timely answer the formal complaint, but appeared at the hearing held in Cheboygan on October 6, 1989. Respondent's motion to set aside default was denied. The default was entered and the hearing panel determined that the default established the allegations of the formal complaint. Respondent was appointed by the court to represent a client for the purpose of appealing a criminal conviction, but failed to take any action to appeal the conviction and failed to reply to the inquiries of the client regarding the status of his efforts on the client's behalf. Respondent's conduct was found to be in violation of MCR 9.104(1-4) and Canons 1, 6, and 7 of the Code of Professional Responsibility, DR 1-102(A)(5,6); DR 6-101(A)(3) and DR 7-101(A)(B). Costs are to be determined at a later date.
