1) Revocation; 2) Effective September 14, 1989. The respondent failed to answer the formal complaints and failed to appear at the hearing held in Midland on August 24, 1989. Respondent's default was entered and the hearing panel determined that the default established the allegations of the formal complaints.
Respondent was retained in a criminal matter and given $500 to be held in a trust and applied towards court ordered restitution, but failed to deposit the funds, misappropriated the funds, and delivered a trust account check in the amount of $500 payable to the County of Saginaw which was dishonored for insufficient funds.
In a separate matter, the respondent was retained in connection with post-judgment divorce proceedings and paid a retainer of $200, but made misrepresentations to his client, failed to answer his client's inquiries, and failed to appear at a hearing on behalf of his client.
In another matter, the respondent was retained in connection with a traffic violation citation and paid a retainer of $100, but failed to perform any services for his client and falsely advised his client that the $100 had been used to resolve the citation. Respondent failed to answer three requests for investigation.
Respondent's conduct was found to be in violation of MCR 9.104(1-3,7); MCR 9.103(C); MCR 9.113(B)(2); Canons 1, 6, 7 and 9 of the Code of Professional Responsibility, DR 1-102(A)(4-6); DR 6-101(A)(3); DR 7-101(A,B); DR 9-102(A); and Michigan Rules of Professional Conduct 1.1(b,c); 1.3 and 1.4(a,b). Costs were assessed in the amount of $112.65.
