NOTICE OF REPRIMAND (By Consent)
ADB 38-89 Thomas E. Moorhead, P-23231, Owosso, MI, by Attorney Discipline Board Ingham County Hearing Panel #3.
1) Reprimand; 2) Effective August 10, 1989. The hearing panel and the Attorney Grievance Commission approved a Stipulation for Consent Order of Discipline executed by the Grievance Administrator and the respondent and submitted in accordance with MCR 9.115(F)(5). The respondent was retained in May 1984 to file a petition for reorganization in the United States Bankruptcy Court and was retained by the same client in September 1985 to institute a #lemon-law# suit involving an allegedly defective vehicle. The respondent admitted allegations that he failed to file certain required documents and failed to appear at a bankruptcy court hearing, that he failed to institute suit on his client#s behalf in the defective vehicle matter, failed to defend an action brought by the manufacturer and failed to appear at a hearing in that case. The respondent's conduct was alleged to be in violation of MCR 9.104(1-4), Canons 1, 6 and 7 of the Code of Professional Responsibility, DR 1-102(A)(1,5,6); DR 6-101(A)(3) and DR 7-101(A)(1-3). Costs were assessed in the amount of $ 188.19.
