NOTICE OF SUSPENSION

DP 135/86; ADB 14-87 Hubert J. Morton, P-25940, Detroit, MI by the Attorney Discipline Board increasing a hearing panel order of suspension of thirty days to a suspension of a 120 days.

1) Suspension - 120 days; 2) Effective July 31, 1989. The respondent was found to have violated a previous order of suspension by engaging in the practice of law after the effective date of the prior order. On appeal, the Attorney Discipline Board affirmed the hearing panel's findings and conclusions but ruled that the misconduct warranted a suspension of 120 days and until the respondent#s reinstatement in accordance with MCR 9.123(B). The Board noted the aggravating effect of respondent's five prior disciplines. Costs were assessed in the amount of $714.24.

The discipline in this case was automatically stayed by the filing of respondent's application for leave to appeal to the Supreme Court. Respondent's application was denied by the Court on July 31, 1989 and the suspension became effective on that date.
