1) Reprimand; 2) Effective July 3, 1989. The respondent failed to answer the Formal Complaints, but appeared at the hearing in Kalamazoo on May 11, 1989. Respondent's defaults were entered and the hearing panel determined that the defaults established the allegations of the Formal Complaints. Respondent was retained to prepare a power of attorney form but failed to do so, refused to refund the retainer fee to the client, and failed to answer the Request for Investigation. Respondent's conduct was found to be in violation of MCR 9.104(1-4,7); MCR 9.103(C); MCR 9.113(B)(2); and Canons 1, 2, 6, 7 and 9 of the Code of Professional Responsibility, DR 1-102(A)(1,5,6); DR 2-110(A)(3); DR 6-101(A)(3); DR 7-101(A)(1-3); and DR 9-102(B)(4). Costs were assessed in, the amount of $306.52.
