AMENDED NOTICE OF REPRIMAND (By Consent)

1) Reprimand; 2) Effective June 6, 1989. The Attorney Grievance Commission and the hearing panel approved a stipulation for consent order of discipline entered In accordance with MCR 9.115(F) (5). The respondent offered a plea of nolo contendere to the formal complaint which charged that on March 25, 1988 the respondent entered pleas of guilty to the offenses of possession of a controlled substance less than fifty grams in violation of MCLA 333.7403 and the offense of operating a vehicle under the influence of a controlled substance (second offense) in violation of MCLA 257.625. The hearing panel was advised that respondent was convicted of the driving offense. He was not convicted of the possession controlled substances offense but was placed on a delayed sentence program under MCL 333.7411 which will result in dismissal of that charge upon successful completion of probation. The respondent's conduct was alleged to be in violation of MCR 9.104(2-5) and Canon 1 of the Code of Professional Responsibility, DR 1-102(A)(1,5,6). Costs were assessed in the amount of $87.05.
