1) Reprimand; 2) Effective August 5, 1989. The hearing panel determined that the respondent's professional misconduct was established as to Count II of the formal complaint. Respondent was retained to act as defense counsel in a criminal matter, but failed to earn the complete sum of the $1500.00 he was paid and failed to refund any portion of that sum. Respondent's conduct was found to be in violation of MCR 9.104(1-4); and Canons 1 and 2 of the Code of Professional Responsibility, DR 1-102(A)(1,5,6) and DR 2-110(A)(3). Costs were assessed in the amount of $479.25.
