1) Suspension - 120 days; 2) Effective May 31, 1989. The respondent failed to answer the Formal Complaint and failed to appear at the hearing held in Birmingham on June 14, 1988. The hearing panel determined that the default established the allegations of the Formal Complaint. Respondent made a loan to a client in the amount of $76,900. Respondent failed to advise the client to seek other counsel, failed to be truthful and candid with the client, and charged a usurious rate of interest. In a separate matter, Respondent was retained in a collection matter and loaned his client $133,701.82. Respondent failed to advise the client to seek independent legal counsel, failed to give receipts for payments received, failed to be truthful and candid with the client, accepted employment from a layman to whom he had given legal advice, and charged a usurious rate of interest. Respondent's conduct was found to be in violation of MCR 9.104(1-4) and Canons 1, 2, 5 and 7 of the Code of Professional Responsibility, DR 1-102(A)(1,4-6); DR 2-104(A); DR 5-101(A); DR 5-103(A,B); DR 5-104(A); DR 7-101(A)(3); and DR 7-102(8). Costs were assessed in the amount of $106.73.
